Terms of Service

Customers acknowledge and agree that all services booked through the Beacon platform are performed by independent contractors who are not employees, agents, or representatives of Beacon or Cascades Digital Corp. (“the Company”).

Beacon acts solely as a marketplace platform to facilitate the connection between customers and service providers.

The Company does not supervise, direct, or control the work, hours, methods, tools, or services performed by the contractors.

All contractors operate as independent businesses and are solely responsible for the services they provide.

The Company does not guarantee or warrant the quality, safety, legality, or any other aspect of the services provided by contractors.

All services are provided “as is” and at the customer’s sole risk.

Beacon and Cascades Digital Corp. expressly disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Beacon and Cascades Digital Corp. shall not be liable for any damages, claims, or losses arising out of or relating to:

• Any acts, omissions, or negligence of any contractor;
   
• Any personal injury, property damage, loss, or theft resulting from services booked through the platform;
   
• Any dispute between a customer and a contractor.
   

In no event shall Beacon or Cascades Digital Corp. be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, even if advised of the possibility of such damages.

Beacon strongly recommends that all contractors maintain appropriate commercial general liability insurance coverage to protect themselves and their customers.

If a contractor provides proof of insurance to Beacon, Beacon may review the documentation for validity at the time of submission.

However, Beacon and Cascades Digital Corp. do not guarantee that all contractors carry insurance or that any insurance remains current or adequate at the time of service.

Customers are solely responsible for conducting any due diligence they deem necessary regarding a contractor’s insurance status or qualifications.

By booking services through Beacon, the customer acknowledges and agrees that:

• The Company is not a party to any service contract between the customer and the contractor.
   
• The Company’s role is limited to facilitating payment, scheduling, and communication between the customer and the contractor.
   
• Any claims, disputes, or issues regarding the performance, quality, or timeliness of the services must be addressed directly between the customer and the contractor.
   

Beacon facilitates payments from customers to contractors and collects a service fee for use of the platform.

Beacon acts as the limited payment collection agent of the contractor solely for the purpose of accepting customer payments and transmitting those payments to the contractor, less applicable platform fees.

As the Merchant of Record, Cascades Digital Corp. is responsible for collecting applicable sales taxes (including GST, HST, or other provincial taxes as required) on the services sold through the platform.

The total amount charged to customers may include applicable taxes, which will be calculated and displayed at checkout.

Contractors are solely responsible for reporting and remitting any income earned through the platform to the appropriate tax authorities. Contractors are independent businesses responsible for their own tax obligations, including but not limited to income taxes, self-employment taxes, GST/HST registration (if required), and any other applicable taxes.

Beacon and Cascades Digital Corp. reserve the right to modify these Terms of Service at any time.

Updated terms will be posted on the platform, and continued use of the platform after any such changes constitutes acceptance of the revised terms.
